THE (RE)DEFINITION OF SANCTIONING ADMINISTRATIVE LAW IN EUROPE: AN ANALYSIS BASED ON THE ITALIAN œGRANDE STEVENS CASE

Abstract

The objective of this article is to analyze the œGrande Stevens v. Italy case, which was heard by the European Court of Human Rights, and verify whether there has been a redefinition of the administrative sanctioning law based on the new horizons of the ne bis in idem principle. The case was studied by the European Court of Human Rights and due to the low scientific production on the subject in the national scenario, the exploratory character was used to expand the search for materials produced by specialized foreign literature (Italian, Portuguese, Spanish and French). The case allows us to reflect on whether there is a wear and tear of the punitive character of the State with administrative sanctions or a renewal based on the needs of today™s society.
